1Definitions and Interpretation

For the purposes of these Terms and Conditions, the following terms shall have the meanings ascribed below:

• "Platform" refers to the aha88 website accessible at https://aha88.cam, including all associated mobile applications, software, and services provided by aha88.
• "Operator" or "We" or "Us" refers to aha88, a gaming operator licensed and regulated by the Philippine Amusement and Gaming Corporation (PAGCOR).
• "User," "You," or "Player" refers to any individual who accesses, registers with, or uses the aha88 Platform.
• "Account" refers to the personal gaming account created by a User upon successful registration on the Platform.
• "Services" refers to all gaming, betting, and related services offered through the Platform, including but not limited to casino games, sports betting, live dealer games, and promotional offerings.
• "Funds" refers to monetary deposits, winnings, bonuses, and other forms of value held in a User's Account.
• "Bonus" refers to promotional credits, free spins, cashback, or other incentives offered by aha88 to Players, subject to specific terms and wagering requirements.
• "Wagering Requirements" refers to the number of times a Bonus or deposited amount must be wagered before withdrawal eligibility is established.

References to singular terms include the plural and vice versa. Headings are for convenience only and do not affect interpretation. The English language version of these Terms shall prevail in case of any discrepancy with translations.

2Acceptance of Terms

By accessing the aha88 Platform, creating an Account, depositing Funds, or participating in any Services, you explicitly accept and agree to be bound by:

1. These Terms and Conditions in their entirety;
2. Our Privacy Policy, which governs the collection, use, and protection of your personal information;
3. Our Responsible Gaming Policy, outlining our commitment to safe and responsible gambling practices;
4. All game-specific rules and regulations as published on the Platform;
5. All promotional terms and conditions applicable to bonuses, tournaments, and special offers;
6. All applicable laws and regulations of the Republic of the Philippines governing online gaming.

We reserve the right to modify, amend, or update these Terms at any time without prior notice. Material changes will be communicated through email notification or prominent notice on the Platform. Your continued use of aha88 Services following such modifications constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

If you do not agree to any provision of these Terms or any subsequent modification, your sole remedy is to discontinue use of the Platform and close your Account in accordance with Section 9 herein.

3Eligibility and Account Registration

3.1 Age Requirement

You must be at least twenty-one (21) years of age to register an Account, access the Platform, or participate in any Services offered by aha88. By registering, you represent and warrant that you meet this minimum age requirement. aha88 reserves the right to request proof of age at any time. Failure to provide satisfactory documentation may result in immediate Account suspension and forfeiture of Funds.

3.2 Jurisdictional Restrictions

You must be physically located within the Republic of the Philippines when accessing the Platform and participating in gaming activities. Use of VPN, proxy servers, or other location-masking technologies to circumvent geographic restrictions is strictly prohibited and constitutes a material breach of these Terms.

You represent and warrant that you are not located in, nor are you a resident or citizen of, any jurisdiction where online gambling is prohibited by law. It is your sole responsibility to ensure that your use of aha88 complies with all applicable local, national, and international laws.

3.3 Account Registration Requirements

To create an Account, you must provide accurate, current, and complete information as requested during the registration process, including but not limited to:

• Full legal name as it appears on government-issued identification;
• Valid email address and mobile phone number;
• Date of birth;
• Residential address;
• Preferred currency and payment method information.

You agree to maintain and promptly update your Account information to ensure accuracy. Providing false, misleading, or fraudulent information constitutes a material breach of these Terms and may result in immediate Account termination and forfeiture of all Funds.

3.4 Account Limitations

Each individual is permitted to register and maintain only one (1) Account with aha88. The creation of duplicate, multiple, or secondary Accounts is strictly prohibited. If we detect multiple Accounts registered under the same individual, payment method, device, IP address, or household, we reserve the right to:

• Immediately suspend or terminate all associated Accounts;
• Void all transactions, bets, and winnings associated with duplicate Accounts;
• Forfeit all Funds held in such Accounts;
• Permanently ban the individual from future participation on the Platform.

3.5 Account Security

You are solely responsible for maintaining the confidentiality and security of your Account credentials, including username and password. You must not disclose your login credentials to any third party. You agree to:

• Use a strong, unique password not shared with other online services;
• Immediately notify aha88 Customer Support if you suspect unauthorized access to your Account;
• Accept full responsibility for all activities conducted through your Account, whether authorized or unauthorized.

aha88 shall not be liable for any losses or damages arising from unauthorized Account access resulting from your failure to maintain adequate security measures.

4Deposits, Withdrawals, and Financial Transactions

4.1 Deposit Policy

aha88 accepts deposits through various payment methods as displayed on the Platform, including but not limited to GCash, PayMaya, bank transfers, and cryptocurrency. All deposits are processed in Philippine Pesos (PHP) or cryptocurrency equivalent. Minimum and maximum deposit limits are displayed on the cashier page and may vary by payment method.

You represent and warrant that all Funds deposited into your Account originate from legitimate sources and belong solely to you. aha88 strictly prohibits money laundering and terrorist financing. We reserve the right to request documentation proving the source of Funds at any time.

4.2 Withdrawal Policy

Withdrawal requests are processed subject to the following conditions:

• Your Account must be fully verified in accordance with our KYC (Know Your Customer) procedures;
• All applicable wagering requirements on bonuses and promotions must be satisfied;
• Withdrawals must be processed using the same payment method used for deposit, unless technically impossible or otherwise agreed with aha88;

Standard withdrawal processing times are fifteen (15) minutes for e-wallet withdrawals and twenty-four (24) hours for bank transfers, though actual receipt of Funds depends on third-party payment processors. aha88 is not responsible for delays caused by external payment service providers.

4.3 Transaction Fees

aha88 does not charge fees for deposits or withdrawals. However, third-party payment processors may impose their own transaction fees, for which aha88 bears no responsibility. Currency conversion fees may apply when transacting in currencies other than your Account's base currency.

4.4 Anti-Money Laundering Policy

aha88 maintains strict anti-money laundering (AML) procedures in compliance with Philippine law and PAGCOR regulations. We reserve the right to:

• Conduct enhanced due diligence on large transactions or suspicious activity;
• Request comprehensive documentation regarding the source of Funds;
• Report suspicious transactions to relevant authorities;
• Freeze Accounts and Funds pending investigation of potential money laundering activity.

Minimum wagering requirements apply to all deposits. Funds must be wagered at least one (1) time before withdrawal eligibility is established. This requirement exists to prevent the Platform from being used for money transfer purposes.

5Bonuses, Promotions, and Wagering Requirements

5.1 Promotional Terms

aha88 offers various bonuses and promotions to Players, including welcome bonuses, reload bonuses, cashback offers, free spins, and tournament prizes. All bonuses are subject to specific terms and conditions, including wagering requirements, game restrictions, time limitations, and maximum bet limits. 5.3 Bonus Abuse Policy

5.4 Promotional Modifications

aha88 reserves the right to modify, suspend, or cancel any promotion at any time without prior notice. In the event of promotional cancellation, any active bonuses will be honored according to their original terms, but new participation will be prohibited.

6Gaming Rules and Fair Play

6.1 Game Integrity

All games offered on the aha88 Platform are provided by licensed third-party game providers and operate using certified Random Number Generators (RNG) to ensure fair and unbiased outcomes. Game RTP (Return to Player) percentages are published where applicable and represent long-term theoretical returns, not guaranteed short-term results.

6.2 Prohibited Activities

Players are strictly prohibited from engaging in the following activities:

• Using automated software, bots, or artificial intelligence to place bets or play games;
• Exploiting software vulnerabilities, bugs, or errors;
• Colluding with other Players or engaging in chip dumping;
• Using insider information for sports betting;

• Using VPN or proxy services to mask location;
• Sharing Account credentials with third parties.

Violation of fair play rules results in immediate Account suspension, forfeiture of Funds, and potential legal action.

6.3 Betting Limits

aha88 reserves the right to impose maximum bet limits on any game or betting market. Limits may vary based on game type, Player history, and promotional restrictions. Exceeding posted limits may result in bet cancellation and potential Account restrictions.

6.4 Game Malfunctions

In the event of game malfunction, communication failure, or technical error, all affected bets and game outcomes are void and Funds will be returned to Player Accounts. aha88 bears no liability for losses resulting from technical issues beyond our reasonable control.

7Intellectual Property Rights

All content displayed on the aha88 Platform, including but not limited to text, graphics, logos, images, software, audio, and video, is the exclusive property of aha88 or its licensors and is protected by Philippine and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal gaming purposes only. This license does not permit you to:

• Reproduce, duplicate, copy, or redistribute any Platform content;
• Modify, adapt, or create derivative works from Platform materials;
• Use Platform content for commercial purposes;
• Remove or alter copyright notices or proprietary markings;
• Reverse engineer or decompile Platform software.

Unauthorized use of aha88 intellectual property constitutes copyright infringement and may result in civil and criminal liability under Philippine law.

8Limitation of Liability and Disclaimers

8.1 Service Availability

While aha88 endeavors to maintain continuous Platform availability, we do not guarantee uninterrupted or error-free service. The Platform may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our reasonable control. aha88 bears no liability for losses resulting from service interruptions.

8.2 Disclaimer of Warranties

THE AHA88 PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AHA88 MAKES NO WARRANTY THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR THAT SERVICES WILL BE TIMELY, SECURE, OR ERROR-FREE.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, AHA88, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF AHA88 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT OF FUNDS DEPOSITED INTO YOUR ACCOUNT DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

8.4 Third-Party Services

The Platform may contain links to third-party websites or integrate third-party services (payment processors, game providers). aha88 is not responsible for the content, privacy practices, or terms of third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

9Account Closure and Termination

9.1 Voluntary Closure

You may close your Account at any time by contacting Customer Support. Upon closure, you must withdraw all Funds from your Account. Any remaining balance after thirty (30) days may be subject to administrative fees. Active bonuses will be forfeited upon voluntary Account closure.

9.2 Suspension and Termination by aha88

aha88 reserves the right to suspend or terminate your Account immediately and without prior notice if:

• You breach any provision of these Terms and Conditions;
• We suspect fraudulent, illegal, or abusive activity;
• You fail to provide requested verification documents;
• Your Account remains dormant for twelve (12) consecutive months;
• We are required to do so by regulatory authorities or law enforcement;
• Continued operation of your Account poses risk to aha88 or other Players.

Upon termination for cause, aha88 may forfeit all Funds held in your Account, including deposits and winnings, if your activities constitute fraud or material breach of these Terms.

9.3 Dormant Accounts

Accounts with no login activity for twelve (12) consecutive months are classified as dormant. Dormant Accounts may be subject to monthly maintenance fees of PHP 200 or equivalent, deducted from the Account balance. We will attempt to notify you before charging maintenance fees.

10Dispute Resolution and Governing Law

10.1 Complaint Procedure

If you have a complaint or dispute regarding any aspect of aha88 Services, you must first contact our Customer Support team at [email protected]. We will endeavor to resolve all complaints within seven (7) business days. Complaints should include detailed information, supporting documentation, and your preferred resolution.

10.2 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.

10.3 Arbitration

In the event that a dispute cannot be resolved through our internal complaint procedure, both parties agree to submit the dispute to binding arbitration under the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in Metro Manila, Philippines, in English language. The arbitrator's decision shall be final and binding on both parties.

11General Provisions

11.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.

11.2 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Responsible Gaming Policy, constitute the entire agreement between you and aha88 regarding your use of the Platform and supersede all prior agreements and understandings.

11.3 Waiver

No waiver by aha88 of any breach or default under these Terms shall be deemed a waiver of any subsequent breach or default. Failure to enforce any provision does not constitute a waiver of our right to enforce that provision in the future.

11.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written consent from aha88. aha88 may assign these Terms or delegate its obligations to any affiliated entity or successor without your consent.

11.5 Force Majeure

aha88 shall not be liable for any failure or delay in performing obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, government actions, labor disputes, internet outages, or technical failures.
